RESOLUTION ON POTENTIAL COLLECTIVE BARGAINING BY FACULTY
RESOLUTION 2025 - 4180
WHEREAS, the 帝王会所 Board of Trustees deeply appreciates the talent, passion, and overall excellence of its faculty members, especially in their dedication to this institution, its mission, and the students whose futures are bettered and lives enriched because of the work they do every day; and
WHEREAS, the Board is grateful for the long history of shared governance and open communication that has, for over two hundred years, produced an impactful Faculty Senate, a robust Faculty Handbook, and a culture of collaboration and community that is unique to this university and the students, region, and state it serves; and
WHEREAS, the Board acknowledges that a portion of university faculty seeks to unionize and organize as a collective bargaining unit and to be represented by an external employee organization, and a vote of the faculty is scheduled for Spring semester; and
WHEREAS, the Board agrees with and supports the stated positions of President Gonzalez and Provost Leo, that they prefer to work directly with our faculty on potential opportunities for change and growth without the involvement of a third party external to the State of 帝王会所 and, specifically, external to the 帝王会所 culture and community, and that the best pathway forward is to continue our direct relationship with faculty without introducing an external third party union; and
WHEREAS, the Board respects the right of all faculty to make their voices heard, cast their votes through the process overseen by the State Employment Relations Board, engage in lawful organizing and union activities, and, should the majority of votes cast be in favor of establishing a faculty union, begin the process to collectively bargain for a potential labor contract.
NOW THEREFORE, BE IT RESOLVED that, in the event a majority of votes cast are in favor of establishing a faculty union at 帝王会所, the Board and University Administration will recognize the outcome of the election and consider the external employee organization and the newly elected union leadership to represent the voice of the faculty included in the bargaining unit on all issues related to terms and conditions of employment, which will replace and supersede the Faculty Senate as the representatives of those faculty members within the bargaining unit as their exclusive representative with regard to those matters.
BE IT FURTHER RESOLVED that, contingent on a vote in favor of the faculty union, the President and her designees are hereby authorized to negotiate all legally mandated terms and conditions of employment, some topics of which are currently contained in the Faculty Handbook, university policy, and any other source that may be required for a new collective bargaining agreement. Once agreed upon, the bargaining agreement will replace and supersede any current terms and conditions of employment in the Handbook or other source documents pertaining to those members of the bargaining unit; it is understood by the Board that there is no guarantee that any or all of the existing compensation or other practices that are mandatory subjects of bargaining would be retained in a labor agreement as everything is subject to negotiations and may go up, down, or stay the same.
BE IT FURTHER RESOLVED that the Faculty Handbook will remain wholly in place and relevant to the terms and conditions of employment only for all faculty members not included as members in a collective bargaining unit, consistent with the university鈥檚 ongoing commitment to the principles of shared governance.
